From January 2006 it became a legal requirement for Registered childminders to register as a food business with their local council

Questions and Answers with regard to Food Safety and Childminders.



What is the legislation that now requires childminders to register as a food business and when is it effective from?
On 1 January 2006, the European Commission introduced new food hygiene regulations which now apply in Northern Ireland. Almost all of the requirements in the new regulations are the same as the regulations they replaced; however the registration requirements have been extended. Regulation (EC) No. 852/2004 now requires that childminders register with the Councils Environmental Health Service

Will the local councils be contacting childminders and informing them about this new piece of legislation? How?
Councils will be sending Food Registration Forms to childminders which will be accompanied by an explanatory letter

What is the process for a childminder to register as a food business?
Childminders should complete the Food Registration form and return to their local Environmental Health Service

What is the time scale for the Childminders to register?
Childminders should complete the Food Registration form and return as soon as possible

Do they still have to register if the parent provides the food which the children eat at the childminding setting?
YES

Is registration renewed annually?
No – you will only need to register once, however if you change address you would be required to re-register

Does it cost anything to register?
NO

What is the penalty if a childminder does not register?
Legal action could be instigated by the Council

Will the childminders home be inspected as a food business and what does this entail?
Some Councils may carry out an inspection of your kitchen, however it is envisaged that guidance on compliance with Food Hygiene legislation will be sent to you as an alternative to an inspection

As a registered childminder the home is inspected by a registering social worker, will they be the persons inspecting the childminder’s setting as a food business?
No, this is the remit of the Environmental Health Service

Is this the same for all of the 26 councils within Northern Ireland?
Each Council may have a different time frame for Food Registration forms to be sent out; however you may wish to contact your local Environmental Health Department of further information

Do Childminders have to adapt their kitchens or complete any training?
It is not envisaged that childminders will have to adapt their kitchens or complete training

What are the benefits for the childminder and the children to register as a food business?
Firstly, it is a legal requirement and as importantly it will enable the Environmental Health Departments to include childminders on their mailing list so that up to date and comprehensive information can to forwarded on to you to assist you in complying with Food Legislation which could possibly negate litigation
